The Supreme Court, on 6 September, is scrapped Section 377 of the IPC which criminalises consensual homosexual sex.
While reading his judgment, Chief Justice of India Dipak Misra noted, “Section 377 is arbitrary. LGBT community posses rights like others. Majoritarian views and popular morality cannot dictate constitutional rights". A five-judge constitution bench headed by Chief Justice Dipak Misra had reserved its verdict on 17 July after hearing various stakeholders, including gay rights activists.
